Environmental Lawyers Eye Impacts of New Trump Executive Orders

Environmental law experts say the two executive orders aimed at changing agencies’ use of informal documents include exceptions and disclaimers that could blunt their effects on the ground, Ellen M. Gilmer writes.

  • The orders that President Trump signed on Oct. 9 target guidance documents, memos, and other informal tools that the Environmental Protection Agency and the Interior Department use routinely to clarify regulations and enforcement policies.
  • “The exceptions and exemptions could swallow much of the impact,” according to Crowell & Moring LLP attorney Amanda Shafer Berman, who previously worked in the Justice Department’s Environment and Natural Resources Division.
