EPA Should Reweigh Petition Over Mustang Birth Control: Judge

The EPA should be ordered to reconsider a petition to review a registered pesticide used as a contraceptive for wild horse and burro populations, a federal judge in Oregon said.

The Environmental Protection Agency didn’t consider the appropriate statutory factors when it denied the request filed by the Friends of Animals advocacy group, Magistrate Judge Patricia Sullivan said for the U.S. District Court for the District of Oregon. Her opinion now heads to a district judge, who will either accept or reject her findings and recommendations.
