New York Sues EPA Over Interstate Ozone Pollution (2)

New York is suing the Environmental Protection Agency to try to compel the agency to act against air pollution drifting from power plants and other pollution sources in upwind states.

The lawsuit, filed April 12 in the U.S. District Court for the Southern District of New York, follows through on the state’s February announcement of its intention to go to court to get the agency to respond to previous pleas for action.

The new litigation opened up another legal front in efforts by East Coast states to prevent air pollution from Midwestern and southern states from driving up their levels...
