Colorado Plumber Sues Over Safety Panel’s Guardrail Citation

Ovation Plumbing Inc. is appealing a federal safety commission’s decision over a fall protection exception that led to nearly $5,000 in fines for the Denver plumbing contractor.

The company filed the lawsuit July 16 in the U.S. Court of Appeals for the Tenth Circuit.

If the Tenth Circuit affirms both the administrative law judge and review commission decisions on the issue, it would give the Occupational Safety and Health Administration “a stronger legal position” when citing companies for violations in the future, Tressi L. Cordaro, principal with Jackson Lewis in Washington, told Bloomberg Environment.
